  • You may use Clockedin as a “Business”, which means we collect information such as that needed to promote jobs you have to Workers, provide you with updates relating to those jobs and charge you for work performed.

Information You Provide 

We collect Personal Data from you when you use our Website, applications or services, or post information in our support system, which may include your first and last name, phone number, zip code, email, professional title, company name, and password. In addition, we (or our third-party credit card and payment processors operating on our behalf) may collect Personal Data including your credit card number, bank account information and social security number when you use Clockedin, for the purpose of providing services that are an integral part of Clockedin, such as paying you for work done. We also retain information on your behalf, such as the Personal Data described above and any correspondence. If you provide us feedback or contact us via email, we will collect your name and email address, as well as any other content included in the email, in order to send you a reply, and any information that you submit to us. When you post in our public support forums, the information contained in your posting will be stored on our servers and other users will be able to see it.

We also collect other types of Personal Data that you provide to us voluntarily, such as browser version, operating system and version, phone model and version, and other requested information if you contact us for support. We may also collect Personal Data at other points in our Website or mobile applications that state that Personal Data is being collected.

Information We Collect Through Technologies 

As you navigate through and interact with our Website, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including details of your visits to our Website and information about your computer and internet connection (such as your IP address, operating system, and browser type). We use your Personal Data in the following ways: for the creation and security of your account, to identify you as a user in our system, to provide administration of our services, to send you an email to verify ownership of the email address provided by you when your account was created, to send you administrative email notifications, to send you alerts you have configured, to notify you of suitable jobs, to pay you for work performed, to charge you for work performed, to respond to requests that you make, to send promotional communications or to otherwise provide the Clockedin service.

In order to notify you of suitable jobs or provide certain features of our services (e.g., checking in for interviews), we use the location information provided by your phone through the Clockedin application. We may receive updates to your location even when the Clockedin application is running in the background. You are able to use your phone settings to prevent Clockedin from obtaining your location. However, this will mean that you will be unable to receive notifications from Clockedin of suitable jobs or use certain features of our Clockedin application.

We may create Anonymous Data records from Personal Data by excluding information (such as your name) that makes the data personally identifiable to you. We use this Anonymous Data to track usage patterns so that we may enhance our Services and improve site navigation. We reserve the right to use Anonymous Data for other purposes and to disclose Anonymous Data to third parties at our discretion.

If you provide feedback on our services, we may use such feedback for any purpose, provided we will not associate such feedback with your Personal Data. We will collect any information contained in such communication and will treat Personal Data in such communication in accordance with this Privacy Policy.

Disclosure of Your Information 

We may disclose your Personal Data that we collect or you provide as described in this Privacy Policy:

  • To third parties to provide technical support or to provide specific services, such as processing payments and providing support to you.

  • To companies with which you accept jobs to enable them to communicate with you regarding those jobs. 

  • To our current or future corporate affiliates or to a buyer, acquiror or other successor of some or all of Clockedin’s assets in which personal information held by Clockedin about our Website users is among the assets transferred.

  • To fulfill the purpose for which you provide it.

  • For any other purpose disclosed by us when you provide the information.

  • With your consent. 

We may also disclose your Personal Data: 

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.

Choices About How We Use and Disclose Your Information

We offer you choices regarding the collection, use, and sharing of your Personal Data. 

We may periodically send you emails that directly promote the use or purchase of our services. When you receive promotional communications from us, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to opt-out by following the unsubscribe instructions provided in the email you receive or by contacting us directly (please see contact information below). Should you decide to opt-out, we may share your email address with third parties to ensure that you do not receive further communications from third parties. Despite your indicated email preferences, we may send you notices of any updates to our Terms of Service or Privacy Policy.

You may change some elements of your Personal Data in your account via our Website or mobile applications or by sending an email to us at the email address set forth below. You may request deletion of your account information by us by sending an email to [support@ClockedIn.com], but please note that we may be required (by law or otherwise) to keep this information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). We will respond to Personal Data access requests within 30 days. When we delete account information, it will be deleted from the active database, but may remain in our archives. We will otherwise retain your information for as long as your account is active or as needed to provide you services, as well as is necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Your California Privacy Rights 

California residents (“Consumers”) have certain additional rights under the California Consumer Privacy Act of 2018 (as amended, the “CCPA”) that are described below. This section of this Privacy Policy (the “California Privacy Section”) and applies only to the personal information (as defined below) of Consumers. In the event of any inconsistency or conflict of any kind between the provisions of this California Privacy Section and the other provisions of this Privacy Policy or any other policy, statement or notice of ours, this California Privacy Section shall control as to Consumers and their rights under the CCPA. 

For purposes of this California Privacy Section, the term “personal information” shall have the meaning set forth in the CCPA. Other terms defined in the Privacy Policy that are not defined in this California Privacy Section shall have the meaning given to them in the Privacy Policy.

  • The categories of personal information that the business sold about the Consumer and the categories of third parties to whom the personal information was sold, by category or categories of personal information for each third party to whom the personal information was sold

2.Right to Request Deletion. A Consumer has the right to request that a business delete any personal information about the Consumer which the business has collected from the Consumer. If it is necessary for us to maintain the personal information for certain purposes, we are not required to comply with a Consumer’s deletion request. If we determine that we will not delete your personal information when you request us to do so, we will inform you and tell you why we are not deleting it. 

3.Right to Opt-Out of Sale of personal information. A Consumer has the right to direct a business that sells personal information about the Consumer to third parties not to sell the Consumer’s personal information. [We do not sell any personal information of Consumers.] 

4.No Discrimination. A Consumer has the right not to be discriminated against because the Consumer exercised any of its rights under the CCPA.

C.How to Submit a Request. To exercise the rights described above in this California Privacy Section, you must submit a verifiable Consumer request to us by emailing us at [support@ClockedIn.com] and providing the requested information.

You may submit a request as frequently as you would like, but we are not required to respond to requests to provide personal information to you more than twice in any 12-month period.

To submit a verifiable Consumer request, you will be asked to provide certain information to help us verify your identity, including your name, email address, phone number or information regarding your previous interactions with us. The information we ask you to provide to initiate a request may differ depending upon the type of request; the type, sensitivity and value of the personal information that is the subject of the request; and the risk of harm to you that may occur as a result of unauthorized access or deletion, among other factors. As required by the CCPA, in response to a Consumer request, we will not disclose a Consumer’s social security number, driver’s license number or other government-issued identification number, financial account number, account password, or security questions and answers, as applicable. 

You may make a verifiable Consumer request on behalf of your minor child. You may also designate an authorized agent to make a request on your behalf. If you designate an authorized agent to make a request on your behalf, we reserve the right to require verification of your authorized agent’s identity and authority, which may include, among other things, a requirement that your authorized agent provide us with (i) your written authorization permitting the authorized agent to submit a request on your behalf or (ii) a duly executed power of attorney permitting the authorized agent to submit a request on your behalf. If we cannot verify your identity or authority to make the request, we will not be able to comply with your request. We will inform you if we cannot verify your identity or authority. We will only use personal information provided in a verifiable Consumer request to verify the requestor’s identity or authority to make the request.

Changes to Our Privacy Policy 

This Privacy Policy is subject to periodic revision. If we make any substantial changes in the way we use your Personal Data, we will notify you by sending you an email to the last email address you provided to us and/or by prominently posting notice of the changes on our Website. Any material changes to this Privacy Policy will be effective upon the earlier of thirty (30) calendar days following our dispatch of an email notice to you of the changes, thirty (30) calendar days following our posting of notice of the changes on our site, or the date that you accept the changes (e.g., by clicking an “I Accept” button or similar means). These changes will be effective immediately for new users of our Website and services. At all times you are responsible for updating your Personal Data to provide us with your most current email address. In the event that the last email address that you have provided us is not valid, or for any reason is not capable of delivering to you the notice described above, our dispatch of the email containing such notice will nonetheless constitute effective notice of the changes described in the notice.
